REACH

On 1 June 2007, EC Regulation No 1907/2006 came into force in the European Union, which provides better protection of human health and the environment from the risks of hazardous substances.

REACH places the burden of proof mainly on companies and no longer on authorities as before.

What is REACH?

REACH stands for Registration, Evaluation, Authorisation and Restriction of CHemicals.

The legislation has an impact not only on substances used in industrial processes or professional settings, but also on substances present in our daily lives, e.g. cleaning products, clothing, electrical appliances and packaging.

Do you control the substances you manufacture or trade?

Under the REACH regulation, companies are required to identify and control the risks associated with the substances they manufacture or trade in the EU. They must demonstrate to the European Chemicals Agency (ECHA) how a given substance can be used safely, and they must disclose the necessary risk reduction measures to users (downstream users).

REACH places the burden of proof mainly on companies and no longer on authorities as before. Besides, there is an obligation for all actors in the production chain to communicate (new) relevant information on the substance and its uses.

Itermediates: info requirements

Within the scope of REACH, registrants and downstream users (DUs) of intermediates may therefore benefit from reduced information requirements on registration, a reduced registration fee or exemption from case evaluation and substance evaluation if they can demonstrate that the intermediate is manufactured and/or used under strictly controlled conditions.

STRICTLY CONTROLLED CONDITIONS (SCC)

SCC refers to a set of specific technical measures, work procedures and management systems that should minimise potential exposure to an intermediate during its life cycle (e.g. targeted training of employees, sampling and analysis, transport regulations, waste management, accident prevention). 

An intermediate is a substance that is manufactured and used for chemical processing in order to be transformed into another substance, and therefore has, by definition, a limited life.
